Terms of Service

Welcome to LinguaCue. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and LinguaCue Inc. ("LinguaCue", "we", "us", or "our") governing your access to and use of our mobile applications, software, website, and related services (collectively, the "Service").

By downloading, installing, accessing, or using LinguaCue, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. End User License (Apple & Google Play)

Subject to your compliance with these Terms, LinguaCue grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on compatible iOS or Android devices that you own or control, solely for your personal, non-commercial educational purposes.

You acknowledge that this agreement is concluded between you and LinguaCue only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the application or its content.

2. Subscription Terms & In-App Purchases (LinguaCue Pro)

LinguaCue offers both a comprehensive free tier and an optional premium subscription known as LinguaCue Pro.

A. Billing & Auto-Renewal

  • Cadence: Subscriptions are available on a monthly or annual auto-renewing basis.
  • Payment Processing: Payment is charged to your Apple ID account or Google Play account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

B. Managing & Canceling Subscriptions

You can manage your subscription or turn off auto-renewal at any time:

  • iOS: Go to your device Settings → [Your Name] → Subscriptions → LinguaCue.
  • Android: Open the Google Play Store app, tap your profile icon → Payments & subscriptions → Subscriptions → LinguaCue.

Canceling a subscription stops future renewals; you will retain access to Pro features until the conclusion of your current billing period.

C. Restoring Purchases

If you switch devices or reinstall the app, you can restore your active purchases anytime by tapping the "Restore Purchases" button located on the Paywall and Settings screens.

3. Free Tier & Guest Access

LinguaCue provides complete guest access allowing you to study flashcards, run spaced repetition sessions, and review vocabulary without requiring account registration. We reserve the right to modify the features included in the free tier with reasonable notice.

4. User Responsibilities & Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to derive the source code of the LinguaCue application or backend algorithms.
  • Scrape, duplicate, or redistribute our proprietary dictionary entries, grammar explanations, or audio recordings for commercial purposes.
  • Use the Service in any manner that could interfere with, disrupt, or impair our infrastructure or networks.
  • Attempt to gain unauthorized access to other user accounts, servers, or cloud databases.

5. Intellectual Property Rights

The Service, including its user interface, code, graphics, branding, FSRS algorithmic adaptations, audio cue designs, and linguistic explanations, are the exclusive property of LinguaCue Inc. and its licensors, protected by copyright, trademark, and intellectual property laws.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WHILE WE STRIVE FOR LINGUISTIC PRECISION, WE DO NOT GUARANTEE THAT ALL TRANSLATIONS, GRAMMAR EXPLANATIONS, OR AUDIO PHONETICS ARE ERROR-FREE OR SUITABLE FOR OFFICIAL CERTIFICATION EXAMINATIONS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LINGUACUE INC., ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT PAID BY YOU TO LINGUACUE IN THE PRECEDING TWELVE MONTHS.

8. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, if you breach these Terms. You may terminate your relationship with us at any time by deleting your account and discontinuing use of the application.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
